What you must know about driving without insurance.

Having an auto insurance policy is mandatory in the Province of Ontario under the Compulsory Automobile Insurance Act (CAIA).

It’s important to note that the owner or lessee is the responsible person for this offence not the driver — unless the driver and owner is the same person. A driver who is not the owner or lessee cannot be charged with operating a motor vehicle with no insurance.

What’s the price of receiving no insurance charges?

If the owner or lessee refuses to provide proof of insurance, does not have insurance or provides false proof of insurance, the penalty can be:

First conviction

  • $5,000 to $25,000+.
  • 25% surcharge = $6,250 to $31,250

Subsequent conviction:

  • $10,000 to $50,000+
  • 25% surcharge = $12,500 to $62,500

You could also face suspension of your driver’s license for up to one year and the vehicle could be impounded for a period up to three months.

A conviction for driving with no insurance puts you in the “High Risk” category with your insurance company resulting in a steep increase in insurance premiums or even the cancellation of your policy for 3 or more years. You need to do all you can to prevent a conviction for no insurance or at least minimize the seriousness of the consequences which can include not only the extremely high fine of $5,000.00 – $50,000.00 plus surcharge, but also the seizure and impound of your vehicle and/or suspension of your licence for up to 1 year.

In addition, the civil aspects of operating a vehicle or permitting its operation without insurance could lead to dealing with lawsuits in the civil courts for years at the cost of hundreds of thousands of dollars.

Other insurance related charges include:

  •  Producing false evidence of insurance
  • Possess false or invalid insurance card
