What is impaired driving?

Impaired driving means operating a vehicle (including cars, trucks, boats, snowmobiles and off-road vehicles) while under the influence of alcohol or drugs.

What is drive – over 80 mg.?

Driving over 80 mg. means operating a vehicle (including cars, trucks, boats, snowmobiles and off-road vehicles) while your blood alcohol level is above the legal limit of 80 mg.

The consequences in Ontario:

Depending on your Blood Alcohol Level you can face a 3 day licence suspension to a lifetime ‘ignition interlock device’ being installed in your vehicle.

If you are convicted of impaired driving or drive over 80 mg.:

The minimum penalty for a first offence is:

  • Having to take a mandatory alcohol education or treatment program
  • There is a 1 year minimum requirement to drive a car equipped with an ignition interlock device
  • No minimum jail sentence
  • $1,000 fine
  • Your Licence will be suspended for 1 year

The minimum penalty for a second offence is:

  • Having to take a mandatory alcohol education or treatment program
  • There is a 3 year minimum requirement to drive a car equipped with an ignition interlock device
  • 30-day minimum jail sentence
  • Fine amount at the discretion of the judge
  • Your licence will be suspended for 3 years

The third and subsequent times:

  • Having to take a mandatory alcohol education or treatment program
  • There is a lifetime minimum requirement to drive a car equipped with an ignition interlock device
  • 120-day minimum jail sentence
  • You will receive a fine amount at the discretion of the judge
  • You will receive a Lifetime licence suspension (can be reduced to 10 years if certain conditions are met)
